This policy applies to every delivery requested or completed through BringYa in Canada. Users, senders, recipients, riders, and merchants must comply with all applicable federal, provincial, territorial, and municipal laws. It distinguishes items that are illegal by law from items BringYa does not accept because it does not hold the required licences.
1. Items prohibited by law
No person may use BringYa to request, offer, possess, transport, deliver, or receive:
1. Illegal drugs, unlawfully possessed controlled substances, illicit cannabis, drug-manufacturing materials, or drug paraphernalia intended for illegal use.
2. Stolen property or property obtained through fraud, theft, robbery, or another criminal offence.
3. Counterfeit currency, fraudulent documents, counterfeit goods, or unlawfully reproduced products.
4. Child sexual abuse and exploitation material, non-consensual intimate images, obscene material prohibited by law, or any other unlawful content.
5. Explosives, prohibited weapons, prohibited devices, illegal firearms, prohibited ammunition, or firearms transported contrary to Canadian law.
6. Dangerous goods offered for transportation contrary to the Transportation of Dangerous Goods Act, 1992 or its regulations.
7. Wildlife, animal products, plants, food, medication, biological material, or other property whose possession or transportation is prohibited by law.
8. Any other item whose possession, sale, transportation, transfer, or delivery would violate applicable law.
2. Items not accepted by BringYa
Even where possession or transportation may be legal in certain circumstances, BringYa does not accept the following items unless BringYa establishes a separately authorized and legally compliant delivery service for that category:
1. Firearms, ammunition, explosives, fireworks, replica weapons, or other weapons.
2. Gasoline, propane, compressed gases, radioactive materials, corrosive substances, toxic chemicals, infectious substances, or other regulated dangerous goods.
3. Cannabis or cannabis products.
4. Cigarettes, tobacco, vaping products, nicotine products, or related age-restricted products.
5. Prescription drugs, controlled medications, medical samples, blood, human tissue, organs, or biohazardous materials.
6. Live animals, insects, human remains, or animal remains.
7. Cash, cryptocurrency storage devices, negotiable instruments, gift cards, precious metals, jewellery, gemstones, or other exceptionally valuable property.
8. Perishable, frozen, or temperature-controlled products that could become unsafe without specialized transportation.
9. Unpackaged sharp objects, leaking containers, broken glass, improperly stored batteries, or anything that could injure a rider or damage a vehicle or another delivery.
10. Any item requiring a permit, licence, certification, special vehicle, regulated packaging, age verification, temperature control, chain-of-custody procedure, or specialized training that BringYa has not expressly agreed in writing to provide.
The availability of a prohibited or restricted category within the app does not mean that BringYa is legally authorized to transport it.
3. Sender’s legal responsibilities
The sender represents and warrants that: the sender legally owns or is authorized to send the item; the item and its transportation comply with all applicable laws; the item has been completely and accurately described; the package does not contain any hidden or undisclosed goods; the item is properly packaged, sealed, labelled, and safe for ordinary transportation; the recipient is legally permitted to receive the item; and any required permits, licences, prescriptions, approvals, or supporting documents are valid.
A user must not mislabel a package, hide its contents, make a false declaration, or ask a rider to transport an item without creating a delivery order through BringYa.
4. Right to refuse, cancel, or stop delivery
BringYa or a rider may refuse, cancel, or stop a delivery when there are reasonable grounds to believe that the package contains a prohibited or restricted item; the description of the contents is false, incomplete, or suspicious; the package is unsafe, damaged, leaking, improperly sealed, or inadequately labelled; the delivery may violate the law or endanger any person, vehicle, property, or the environment; or the sender or recipient refuses to provide legally required identification or information.
BringYa may request photographs, receipts, proof of ownership, permits, identification, or additional information. BringYa may also ask the sender to voluntarily open the package to confirm its contents. Riders are not authorized to open packages without consent or lawful authority.
5. Suspected illegal items
Where legally required or permitted, BringYa may stop or cancel the delivery; secure the package in a reasonably safe manner; contact police, emergency services, regulators, or other authorities; provide relevant account, transaction, pickup, delivery, and tracking information to the appropriate authorities; and follow lawful instructions concerning the detention, surrender, return, or disposal of the package.
BringYa is not required to return an item when returning or transporting it would be unlawful or unsafe.
6. Charges and responsibility
If a delivery is refused or cancelled because of a prohibited item, misrepresentation, unsafe packaging, or legal non-compliance, the sender may be responsible for applicable cancellation, travel, waiting-time, return, storage, cleaning, disposal, administrative, and emergency-response costs.
To the maximum extent permitted by law, BringYa and its riders are not responsible for the seizure, confiscation, detention, destruction, loss, or non-delivery of prohibited or unlawfully transported items.
The sender is responsible for losses, injuries, claims, fines, penalties, vehicle damage, cleanup costs, and reasonable legal expenses resulting from the sender’s prohibited item, false declaration, unlawful conduct, or unsafe packaging.
Nothing in this policy limits any consumer right or remedy that cannot legally be waived.
7. Account enforcement
BringYa may suspend or terminate an account for attempting to send a prohibited item; concealing or misrepresenting package contents; providing false identification or documentation; endangering a rider or another person; or violating this policy or applicable law.
Serious or repeated violations may be reported to the appropriate authorities.
8. User confirmation
Before submitting a delivery request, the sender must confirm:
“I confirm that this package does not contain any illegal, dangerous, prohibited, restricted, or undisclosed item. I have accurately described its contents, and I accept legal and financial responsibility for the package and its transportation.”
Relevant Canadian and Alberta authorities include the Transportation of Dangerous Goods Act, Controlled Drugs and Substances Act, Cannabis Act, Firearms Act, and Alberta’s AGLC delivery requirements.
