These Terms of Service (“Terms”) are a legally binding agreement between you and the operator of BringYa (“BringYa”, “we”, “us”). They govern your use of the BringYa websites, APIs, and the BringYa mobile application on iOS and Android (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.
1. Who may use BringYa
You must be at least 18 years old and able to form a binding contract under the laws of Alberta to create an account, book a delivery, or apply as a rider. The Services are not directed to children. If we learn that we have collected personal information from anyone under 18, we will delete the account.
You must provide accurate registration details, keep your password confidential, and tell us promptly if you suspect unauthorized use of your account. You are responsible for activity under your account.
2. The service
BringYa is a local small-parcel delivery platform. A customer may request pickup and drop-off of one small parcel within an active service area (currently Edmonton). A fare is calculated on our servers from road distance and published rates. Nearby approved riders may accept the job, or an administrator may assign a rider.
BringYa is a marketplace technology platform. We do not ourselves carry parcels as a common carrier unless we expressly say so for a given order. Riders who accept jobs provide delivery services as independent contractors and are not employees, partners, or agents of BringYa unless a separate written agreement says otherwise.
We do not guarantee that a rider will be available, that a delivery will complete by a particular time, or that every address in a city is inside an active zone. Quotes expire. Historical orders keep the pricing snapshot used at the time of booking.
3. Customer responsibilities
You must pack items safely, describe them honestly, and only send items that are legal to possess and transport in Canada. You must provide accurate pickup and drop-off addresses, a reachable receiver name and phone number, and any access instructions needed for a safe handoff.
Before every delivery request you must confirm the Prohibited and Restricted Items Policy in section 4 and the declaration in section 4.8. A delivery posted without that confirmation is not accepted.
Cash and card fares are due as shown before you post an order. Waiting time after a rider arrives at pickup may increase the final amount according to the published waiting rule. Temporary card authorizations may exceed the estimate until the final fare is captured.
4. Prohibited and Restricted Items Policy
Effective Date: 20 August 2026. This policy applies to every delivery requested or completed through BringYa in Canada. Users, senders, recipients, riders, and merchants must comply with all applicable federal, provincial, territorial, and municipal laws.
This policy distinguishes between items that are illegal by law and items BringYa does not accept because it does not hold the required licences. The full policy is also published at https://bringya.ca/prohibited-items.
4.1 Items prohibited by law
No person may use BringYa to request, offer, possess, transport, deliver, or receive:
1. Illegal drugs, unlawfully possessed controlled substances, illicit cannabis, drug-manufacturing materials, or drug paraphernalia intended for illegal use.
2. Stolen property or property obtained through fraud, theft, robbery, or another criminal offence.
3. Counterfeit currency, fraudulent documents, counterfeit goods, or unlawfully reproduced products.
4. Child sexual abuse and exploitation material, non-consensual intimate images, obscene material prohibited by law, or any other unlawful content.
5. Explosives, prohibited weapons, prohibited devices, illegal firearms, prohibited ammunition, or firearms transported contrary to Canadian law.
6. Dangerous goods offered for transportation contrary to the Transportation of Dangerous Goods Act, 1992 or its regulations.
7. Wildlife, animal products, plants, food, medication, biological material, or other property whose possession or transportation is prohibited by law.
8. Any other item whose possession, sale, transportation, transfer, or delivery would violate applicable law.
4.2 Items not accepted by BringYa
Even where possession or transportation may be legal in certain circumstances, BringYa does not accept the following items unless BringYa establishes a separately authorized and legally compliant delivery service for that category:
1. Firearms, ammunition, explosives, fireworks, replica weapons, or other weapons.
2. Gasoline, propane, compressed gases, radioactive materials, corrosive substances, toxic chemicals, infectious substances, or other regulated dangerous goods.
3. Cannabis or cannabis products.
4. Cigarettes, tobacco, vaping products, nicotine products, or related age-restricted products.
5. Prescription drugs, controlled medications, medical samples, blood, human tissue, organs, or biohazardous materials.
6. Live animals, insects, human remains, or animal remains.
7. Cash, cryptocurrency storage devices, negotiable instruments, gift cards, precious metals, jewellery, gemstones, or other exceptionally valuable property.
8. Perishable, frozen, or temperature-controlled products that could become unsafe without specialized transportation.
9. Unpackaged sharp objects, leaking containers, broken glass, improperly stored batteries, or anything that could injure a rider or damage a vehicle or another delivery.
10. Any item requiring a permit, licence, certification, special vehicle, regulated packaging, age verification, temperature control, chain-of-custody procedure, or specialized training that BringYa has not expressly agreed in writing to provide.
The availability of a prohibited or restricted category within the app does not mean that BringYa is legally authorized to transport it.
4.3 Sender’s legal responsibilities
The sender represents and warrants that: the sender legally owns or is authorized to send the item; the item and its transportation comply with all applicable laws; the item has been completely and accurately described; the package does not contain any hidden or undisclosed goods; the item is properly packaged, sealed, labelled, and safe for ordinary transportation; the recipient is legally permitted to receive the item; and any required permits, licences, prescriptions, approvals, or supporting documents are valid.
A user must not mislabel a package, hide its contents, make a false declaration, or ask a rider to transport an item without creating a delivery order through BringYa.
4.4 Right to refuse, cancel, or stop delivery
BringYa or a rider may refuse, cancel, or stop a delivery when there are reasonable grounds to believe that the package contains a prohibited or restricted item; the description of the contents is false, incomplete, or suspicious; the package is unsafe, damaged, leaking, improperly sealed, or inadequately labelled; the delivery may violate the law or endanger any person, vehicle, property, or the environment; or the sender or recipient refuses to provide legally required identification or information.
BringYa may request photographs, receipts, proof of ownership, permits, identification, or additional information. BringYa may also ask the sender to voluntarily open the package to confirm its contents. Riders are not authorized to open packages without consent or lawful authority.
4.5 Suspected illegal items
Where legally required or permitted, BringYa may stop or cancel the delivery; secure the package in a reasonably safe manner; contact police, emergency services, regulators, or other authorities; provide relevant account, transaction, pickup, delivery, and tracking information to the appropriate authorities; and follow lawful instructions concerning the detention, surrender, return, or disposal of the package.
BringYa is not required to return an item when returning or transporting it would be unlawful or unsafe.
4.6 Charges and responsibility
If a delivery is refused or cancelled because of a prohibited item, misrepresentation, unsafe packaging, or legal non-compliance, the sender may be responsible for applicable cancellation, travel, waiting-time, return, storage, cleaning, disposal, administrative, and emergency-response costs.
To the maximum extent permitted by law, BringYa and its riders are not responsible for the seizure, confiscation, detention, destruction, loss, or non-delivery of prohibited or unlawfully transported items.
The sender is responsible for losses, injuries, claims, fines, penalties, vehicle damage, cleanup costs, and reasonable legal expenses resulting from the sender’s prohibited item, false declaration, unlawful conduct, or unsafe packaging.
Nothing in this policy limits any consumer right or remedy that cannot legally be waived.
4.7 Account enforcement
BringYa may suspend or terminate an account for attempting to send a prohibited item; concealing or misrepresenting package contents; providing false identification or documentation; endangering a rider or another person; or violating this policy or applicable law.
Serious or repeated violations may be reported to the appropriate authorities.
4.8 User confirmation
Before submitting a delivery request, the sender must confirm:
“I confirm that this package does not contain any illegal, dangerous, prohibited, restricted, or undisclosed item. I have accurately described its contents, and I accept legal and financial responsibility for the package and its transportation.”
Relevant Canadian and Alberta authorities include the Transportation of Dangerous Goods Act, Controlled Drugs and Substances Act, Cannabis Act, Firearms Act, and Alberta’s AGLC delivery requirements.
5. Rider responsibilities
Becoming a customer does not make you a rider. Rider mode is available only after you submit an application, provide requested documents, and we approve you. We may request additional documents, suspend, or reject an application.
When you go online you must have a valid licence and insurance for the vehicle you use, follow traffic laws, and treat customers, receivers, and parcels with care. You must capture required pickup and delivery proof and enter the receiver’s delivery PIN when the product requires it.
If you collect cash, you hold company funds in trust until you remit them according to our payout and cash-reconciliation process. Rider earnings are separate from the customer fare and are determined by the compensation snapshot stored on each delivered order.
6. Location, tracking, and communications
Customers may use location while choosing addresses. Riders who go online or accept a job must allow location while using the app (“While Using the App” on iOS, “While using the app” on Android). That is enough to receive nearby jobs and share live tracking during a delivery. All the time / Always is optional and only keeps tracking live if you switch apps or lock the phone. You can go offline to stop job offers. Turning location off in system settings will prevent Rider mode from working.
Each confirmed delivery creates a public tracking link with a high-entropy token. Anyone with the link can see limited status, ETA, and, after pickup, approximate rider location. Do not share the link more widely than you intend. You may regenerate or revoke a link. Receivers do not need an account.
We may send SMS one-time codes, transactional messages about your orders, and operational notices. Marketing messages, if any, will include a way to opt out.
7. Payments, refunds, and payouts
Fares, taxes, waiting charges, and rider compensation are calculated in Canadian dollars and stored as integer cents. We do not store full payment-card numbers. Card payments are processed by a third-party payment processor when that method is enabled. Cash orders are collected by the rider from the paying party.
Refunds, cancellations, and fare adjustments are handled according to order state and may require administrator review. Illegal or abusive use may be refused a refund. Payouts to riders and remittances from riders are recorded in our settlement ledger. Recording a payout in the admin console does not itself move money; it records a transfer you make by Interac, cash, or another agreed method.
8. Acceptable use
You must not misuse the Services: no scraping, no interfering with other users, no fake GPS, no attempting to access other accounts, no posting malware, and no using the platform to commit fraud or harassment. We may suspend or terminate accounts that violate these Terms, applicable law, or Apple or Google platform rules.
9. Intellectual property
BringYa, the app, the website, logos, and related content are owned by us or our licensors. You receive a limited, revocable, non-exclusive licence to use the Services for their intended purpose. You may not copy, reverse engineer, or resell the platform except as allowed by law.
10. Disclaimers and limitation of liability
The Services are provided “as is” and “as available.” To the fullest extent permitted by Alberta law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that a parcel will be free from loss or damage.
To the fullest extent permitted by law, BringYa’s total liability arising out of the Services is limited to the greater of (a) the fare you paid us for the order giving rise to the claim or (b) CAD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data, even if we were advised they were possible. Some jurisdictions do not allow certain limitations; in those cases the limitation applies only to the extent allowed.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud or for death or personal injury caused by negligence where such exclusion is prohibited.
11. Indemnity
You will defend and indemnify BringYa and our officers, contractors, and riders against claims arising from your parcel contents, your breach of these Terms, or your violation of law, except to the extent caused by our wilful misconduct.
12. Termination and account deletion
You may delete your account at any time in the BringYa app (Account → Delete account) or on the website (Account → Profile → Delete account), or by emailing support@bringya.ca from the address on the account. Deletion signs you out of all devices, disables login, and removes or anonymizes personal profile data. We may retain order, payment, and audit records as required by law or to complete in-progress deliveries and prevent fraud.
We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Services. Active deliveries may still need to be completed or cancelled according to operational rules.
13. Apple and Google app stores
If you download the app from the Apple App Store or Google Play, you also agree to the applicable store’s terms. Apple and Google are not parties to these Terms and are not responsible for the app or its content. Support is provided by BringYa, not by Apple or Google. In-app purchases, if offered later, will use the store billing rules then in force.
14. Changes
We may update these Terms. The updated version will be posted at https://bringya.ca/terms with a new “Last updated” date and in the app. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services and delete your account.
15. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts in Edmonton, Alberta have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction. If a provision is unenforceable, the rest remains in effect.
